WEF Comments on EPA’s Proposed MS4 Permit Remand Rule

The Water Environment Federation (WEF; Alexandria, Va.) provided public comments on the proposed U.S. Environmental Protection Agency (EPA) Phase II Municipal Separate Storm Sewer System (MS4) permit remand rule which was published in the Federal Register on Jan. 6.

WEF’s comments respond to questions posed by EPA and focus on providing maximum flexibility to the MS4 Phase II regulated sector. EPA also requested comments on three potential options for how to run the program. WEF recommended that EPA adopt option 3, called the state choice approach, which would accommodate a diversity of approaches currently used by different states. This option would provide permitting authorities with the authorization to choose the program administrative approach that best fits their individual needs.
